Legal insurance was virtually unheard of twenty to thirty years ago because it was not really needed. Individuals settled personal scores the old fashioned way and accepted responsibility or blame if they injured themselves. Life was so much simpler then. Now we live in a society where suing is almost as commonplace as it is across the Atlantic.
We have all seen the claim advertisements on TV for claim companies that promise to take no-win no fee cases and other similar promises. They only serve to encourage the culture that we have found ourselves a part of today. Nothing is ever our personal fault anymore and someone else is always to blame. The suing culture is such that we should take every penny we can from others if there is reasonable evidence that points to the liability of others. This has led to legal expense insurance becoming offered by more and more insurance companies every year.
Legal expense insurance is the most common type of legal insurance and is available to almost everyone, with the exception of foreign nationals with temporary work permits and those individuals that are already in prison. There are two distinct types of legal insurance to choose from, but they are situation and circumstance specific so you do not get a choice as to which one you want. It is all dependent on which on you need instead.
The first type of legal expanse insurance is the after the event policy. If you have an accident then a lawyer will insist on you taking out an after the event legal insurance policy because it will ensure that they get paid should you lose your case. It is designed to protect you against massive legal costs but is recoverable in the event of a successful claim. It is often just a precaution because ethical lawyers will generally not take your case if they believe that you will lose it. You always take an after the event policy out if you have already had an accident. They can be very expensive if your solicitor will not cover the cost of it, although some will and expect to make the cost back via a payment plan in the event of an unsuccessful case.
Even if you have not had an accident or made a claim, you can still take out the other type of legal insurance. Before the event legal insurance is widely available at very little cost. It is commonly found as an add on to a general home or car insurance policy and will generally cover legal expenses up to a specific amount. The cost of the policy will be added to your total premium so that you pay for it with the insurance you already have. You can, in some circumstances add it to your existing policy if your provider does offer legal expense insurance. There are usually exclusions, such as being invalid during any ongoing cases that you may already have when you take out the cover. However, this will all be explain fully in the small print.
Legal insurance, or legal expense insurance, can be extremely useful in this day and age and should definitely be considered when you are sorting through all your paperwork or any of your other policies are coming up for renewal. You are only allowed the one policy because claiming on more than one would actually render both claims invalid. However, that little bit of peace of mind that it gives you, knowing that you will not be liable for huge costs should anything happen, is definitely worth it. Especially considering how much solicitors fees are these days! |
